Short version: Use a gift deed to hand over a property now to one person. Use a settlement deed to arrange who gets what, often with conditions like a life interest for you. Use a will to pass property after your death while keeping full control until then. Gift and settlement deeds on immovable property must be registered and pay stamp duty. A will needs two witnesses, but registration is optional and no stamp duty applies.
Families mix these three up all the time, and the wrong choice can cost lakhs in tax or years in court. This guide explains what each one does, what it costs (with Karnataka verified), how tax works under the new Income-tax Act, and when a transfer can be undone.
Which should I choose?
Your situation | Usually suits |
|---|---|
Give a flat to one child now, with no strings | Gift deed |
Give property to several family members, with defined shares or a life interest for you | Settlement deed |
Keep full control and ownership until you die | Will |
Want to change your mind later | Will |
One sibling gives up a share in inherited property to another co-owner | Release deed |
Give property to a spouse or minor child | Gift deed, but read the tax note on clubbing below |
What is a gift deed?
A gift deed transfers ownership of property from the donor to the donee without payment. Under the Transfer of Property Act, 1882, a valid gift needs the donee’s acceptance during the donor’s lifetime. For immovable property, the deed must be in writing, signed by the donor, attested by at least two witnesses and registered. Ownership moves on registration, and you can’t take it back just because you change your mind.
What is a settlement deed?
A settlement deed is a registered document by which the owner arranges how property will be held by family members. It’s the usual tool when you want to:
split property among several people with defined shares,
keep a life interest, so you can live in or earn from the property until you die, or
attach conditions about how the property is used or passed on.
A gift deed can also carry some conditions, but a settlement deed is the more natural fit for structured arrangements.
What is a will?
A will says who gets your property after your death. Under the Indian Succession Act, 1925, it must be made freely by a person of sound mind and signed with two attesting witnesses. You can change or cancel it any time during your life. Registration isn’t compulsory, and an unregistered will is valid, but a registered will is harder to dispute on execution. A will doesn’t need stamp duty.
How do they compare?
Gift deed | Settlement deed | Will | |
|---|---|---|---|
When ownership moves | On registration, during your life | On registration, subject to the terms | After your death |
Can you reverse it? | Only in limited legal situations | Depends on the deed’s terms and law | Yes, any time |
Registration | Mandatory for immovable property | Mandatory for immovable property | Optional |
Stamp duty | Yes, state rates | Yes, state rates | None |
Can include a life interest or conditions | Limited | Yes | Yes |
Best for | One recipient, immediate transfer | Several recipients, structured shares | Control until death |
A will can’t override a registered gift or settlement already completed in your lifetime, because that property has already left your ownership.
What does it cost in Karnataka?
Stamp duty is a state subject, so rates differ across India. These are verified for Karnataka.
Deed | Stamp duty | Registration fee |
|---|---|---|
Gift to specified close family, property in BBMP, BMRDA or city corporation areas | Flat Rs 5,000 | Concessional fee. Sources vary, so check Kaveri. |
Gift to specified close family, city or town municipal areas | Flat Rs 3,000 | Same |
Gift to specified close family, rural areas | Flat Rs 1,000 | Same |
Gift to non-family | 5% of market value, plus cess | 2% (the general fee doubled from 1% on 31 August 2025) |
Settlement or release within the family | A similar slab structure, reported when it was introduced | Check Kaveri |
Will | None | Optional |
Two cautions. First, the “family” concession covers specified close relatives. Sources say siblings may not qualify in Karnataka, so check before you plan a gift between brothers or sisters. Second, the registration fee for family gifts is reported differently across sources (Rs 500, Rs 1,000, or 1% to 2%). Confirm the amount on the Kaveri portal or with the sub-registrar’s office before you budget.
Is a gifted or inherited property taxable?
Gift deed. Under the old Income-tax Act, 1961, gifts of immovable property above Rs 50,000 (stamp duty value) were taxed in the recipient’s hands unless an exemption applied. From 1 April 2026, the same rule continues under Section 92 of the Income-tax Act, 2025. The key exemption is gifts from “relatives”, which include parents, spouse, siblings and other specified relatives, and these are tax-free at any value. Gifts from friends and non-relatives are taxable.
Will or inheritance. Property received through a will or inheritance is generally exempt from tax in the recipient’s hands.
Clubbing. Receiving a gift can be tax-free, but income from the gifted property can still be added to the donor’s income in some cases. This commonly applies to gifts to a spouse or a minor child. Ask your CA before you gift a rented flat to your spouse.
What tax applies when the family sells it later?
When the recipient sells a gifted or inherited property, capital gains tax applies. The recipient generally steps into the previous owner’s shoes: the original owner’s cost is used for the gain, and the holding period includes the previous owner’s. For property held more than 24 months, long-term gains are taxed at 12.5% without indexation. Residents who inherited or received property originally bought before 23 July 2024 may be able to choose 20% with indexation. Have your CA run both options.
Can a gift deed, settlement deed or will be cancelled?
Will: yes, any time during the testator’s lifetime.
Gift deed: a completed gift can’t be cancelled just because the donor changes their mind. The Transfer of Property Act allows revocation in limited cases, such as an agreed condition that doesn’t depend on the donor’s will, or fraud and undue influence.
Settlement deed: revocation depends on the deed’s terms and the law.
Senior citizens. Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 covers transfers “by way of gift or otherwise”. A tribunal can declare a transfer void if it was made subject to a condition that the recipient would look after the senior citizen’s basic needs, and the recipient fails to do so. The Supreme Court dealt with this in Sudesh Chhikara (2022) and Urmila Dixit (January 2025), and some courts have accepted an implied condition. Other courts want an express recital. If you are a parent transferring property, writing a care condition into the deed makes your position clearer.
What about ancestral property?
Ancestral property is different. As a general rule, a coparcener can’t gift an undivided share of ancestral property without partition, and you can’t leave the whole property to one child if others have rights in it. A person may be able to will their own share. Get legal advice on whether the property is ancestral and whether it has been partitioned before you pick an instrument.
When does a release deed suit siblings better?
A release (or relinquishment) deed suits co-owners of inherited property when one co-owner gives up their share in favour of another. A gift deed is for a voluntary transfer between eligible parties. Because the family stamp-duty concession may not cover siblings in Karnataka, a release deed is often the cleaner route between brothers and sisters. Confirm the duty for your deed on Kaveri.
How do I register a gift or settlement deed in Karnataka?
Check the title. Get the sale deed, khata, tax receipts and an encumbrance certificate from the Kaveri portal.
Draft the deed. Include the parties, property description, relationship, any life interest or conditions, and a care clause if the donor is a senior citizen.
Pay stamp duty through e-stamping.
Book an appointment and go to the sub-registrar’s office with the donor, donee, two witnesses, ID and address proofs, ownership papers and photographs. Present the deed for registration within four months of signing.
Collect the registered deed after verification.
Update the khata and records. In Bengaluru, apply to change the khata (e-Khata) in the new owner’s name, and update property tax records.
What mistakes do families make?
Using a gift deed when a settlement deed (with a life interest) is what they actually want.
Assuming a will can undo a registered gift made earlier.
Gifting to a sibling and expecting the family concession.
Gifting a rented flat to a spouse without thinking about clubbing.
Forgetting to update the khata and tax records after registration.
Errors in names, shares or property descriptions.
Not checking whether the property is ancestral or in a partition dispute.
Frequently asked questions
What is the difference between a gift deed and a settlement deed?
A gift deed transfers ownership to someone now, as a voluntary gift. A settlement deed arranges how property is held among family members, often with shares, conditions or a life interest for the owner. Both need registration for immovable property.
Is a gift deed better than a will?
A gift deed moves ownership now and is hard to reverse. A will keeps ownership with you until death and can be changed any time. Choose based on whether you want to keep control.
Can a will override a registered gift deed?
No. Once a gift is completed by registration, the property is no longer yours to leave in a will.
Is a will valid without registration?
Yes, if it’s properly signed and attested by two witnesses.
Is probate required in Bengaluru?
Not for wills made in Bengaluru. Probate is mandatory only for wills made in the old presidency towns of Mumbai, Chennai and Kolkata, and in other cases it depends on your facts.
Is property received as a gift taxable?
Gifts of property from relatives are tax-free. Gifts from non-relatives above Rs 50,000 (stamp duty value) are taxable. The rule is now in Section 92 of the Income-tax Act, 2025.
Can I get a home loan on a gifted property?
Often, yes, if the lender is satisfied with the registered deed, title and updated records. Policies vary by lender.
Can an NRI receive property by gift?
Under FEMA, an NRI or OCI can generally receive residential or commercial property by gift or inheritance from eligible relatives. Agricultural land, plantations and farmhouses are restricted. Confirm the details with your bank and CA.
Can I cancel a gift deed to my child?
Not simply because you changed your mind. If you are a senior citizen and the child fails to look after you, you may apply under Section 23 of the Senior Citizens Act, 2007.
